The Office of the Comptroller of the Currency (OCC) recently released a final rule strengthening and modernizing the agency’s regulations under the Community Reinvestment Act (CRA). The CRA was enacted in 1977 to encourage insured depository institutions to help meet the credit needs in their local communities, including low- and moderate-income neighborhoods. It was created as a reaction to the practice of redlining, where banks avoided making loans to low-income neighborhoods.
The affordable housing industry has an interest in these proposals because affordable housing and community development plays a role in whether financial institutions meet their CRA requirements. Although the CRA doesn’t mention the LIHTC program, the program benefits from its ties to CRA credit. An estimated 85 percent of LIHTC investment is made by CRA-intentioned banks. In addition, the Opportunity Zone (OZ) incentive is generally applicable to low-income neighborhoods and, as such, much OZ investment potentially qualifies for CRA credit.
According to the OCC, the final rule will increase bank CRA-related lending, investment, and services in low- and moderate-income communities where there is significant need for credit, more responsible lending, and greater access to banking services. The final rule reflects careful consideration of the more than 7,500 comments stakeholders submitted in response to the notice of proposed rulemaking announced on Dec. 12, 2019.
