Send Copies of Notices to Several Locations

Tenants sometimes complain that they don't receive notices sent by owners, which can lead to arguments if they lose valuable lease rights or options, or wind up defaulting on their leases because they didn't know that their owners were trying to contact them. This doesn't affect only your tenant negatively, though. You can lose money if you need a response from the tenant, especially when time is of the essence, but the tenant didn't realize it needed to take action.

It's a good idea to send notices to several locations where the tenant is likely to receive them, but this is easier said than done. That's because many tenants operate their businesses out of several locations, have official headquarters in another state, or—especially with small companies—do paperwork from employees' home offices.

Tell the tenant that you'll send copies of your notices to the tenant at the locations where it rents space from you, its corporate headquarters, and its attorney's office. And ask if it has a home office where notices can be sent.

This way, there's a greater chance that a notice will reach the tenant so that it can respond appropriately before a deadline passes, avoiding headaches and legal issues for you. To do this, add the following language to your lease's notice clause:

Model Lease Language

All notices to Tenant under this Lease shall be sent to Tenant both at the Premises and at its corporate headquarters, located at [insert address], along with a copy to Tenant's attorneys, [insert name of attorneys], at [insert address of attorneys].
