HUD Delays HOTMA Implementation for Multifamily Housing

HUD recently issued Notice H2023-10 that provides guidance to multifamily housing owners regarding the implementation of the many program changes brought about by the Housing Opportunity Through Modernization Act of 2016 (HOTMA). The recent notice makes implementation changes for sections 102 and 104 of HOTMA that were detailed in the final rule published by HUD in the Federal Register on Feb. 14, 2023. It’s important to note that the IRS intends to follow the HOTMA final rule regarding the determination of income and assets.

HUD Charges Owner with Disability Discrimination

The case shows how mishandling situations involving assistance animals could cost you. HUD recently charged an owner with violating the Fair Housing Act by refusing a resident’s request for a disability-related reasonable accommodation to keep an assistance animal and by subjecting the resident to retaliation for requesting a reasonable accommodation.

HUD Aligns Inspection Regulations, Publishes NSPIRE Final Rule

After seven years of working towards consolidating, updating, and improving the Housing Quality Standards (HQS) and the Uniform Physical Condition Standards (UPCS) to implement a single inspection protocol for HUD-assisted units, HUD recently published the final rule for the Physical Inspection of Real Estate (NSPIRE) in the Federal Register. The rule proposes a new approach to defining and assessing housing quality and reduces regulatory burden. According to HUD, the publication of the final rule follows 16 listening sessions in 15 states with more than 3,330 attendees.

IRS Extends Placed-in-Service and Other COVID Relief Deadlines

In an announcement made in early October, the Biden administration announced key progress on implementing its Housing Supply Action Plan. The plan aims to create and preserve hundreds of thousands of affordable housing units in the next three years and help close the country’s critical housing supply shortfall within five years. It features a combination of legislative, regulatory, and administrative steps to expand affordable housing and encourage the construction and rehabilitation of housing of all types and price points.
