Know Your Responsibilities During Presidentially Declared Disaster or HUD-Determined Emergency

Recently, Louisiana Gov. John Bel Edwards said that he’s “extremely grateful” that Tropical Depression Barry didn’t cause the devastating floods that had been projected. According to the National Weather Service, Barry was briefly a Category 1 hurricane, but the system weakened to a tropical storm and eventually became a tropical depression as a result of weakening winds. Still, after reaching land, the National Weather Service warned of ongoing dangers posed by storm surges and the possibility of tornadoes in areas including parts of Louisiana and Mississippi.

City's Section 8 Antidiscrimination Ordinance Doesn't Violate Owner's Rights

Facts: An owner sued the city over a new law that bars owners from screening out prospective tenants who use Section 8 vouchers. Under the new rules, owners can screen prospective renters but can no longer stipulate that Section 8 tenants aren’t allowed. The ordinance grants reprieve for landlords who can show compliance would create an “undue hardship,” though only after a discrimination claim is filed with the city’s Civil Rights Department.

Defective Pre-Termination Notice Included Undesignated Charges

Facts: A Section 8 resident signed a HUD model lease for a unit. The term of the lease was for one year, and the resident remained in the unit after the first year on a month-to-month basis. The owner filed for eviction based on the nonpayment of rent in the amount of $1,402.

Resident Breached Lease by Failing to Pay Rent

Facts: A resident of a HUD-assisted site received a rent subsidy that reduced her monthly portion of the rent to $139 of the total rent of $532. The owner sent the resident a “Notice of Termination of Lease” informing her that her lease would be terminated effective Dec. 31, 2016.

Senate Confirms Two HUD Assistant Secretaries

The Senate recently confirmed Hunter Kurtz to be HUD Assistant Secretary for Public and Indian Housing (PIH) and Seth Appleton to be HUD Assistant Secretary for Policy Development and Research (PD&R). HUD Secretary to Chair White House Council on Affordable Housing

President Trump recently signed an Executive Order to establish the White House Council on Eliminating Barriers to Affordable Housing Development. The council is headed by HUD Secretary Ben Carson and consists of members across eight federal agencies. They will engage with state, local, and tribal leaders across the country to identify and remove the government regulations that impede the production of affordable homes. To curtail burdensome regulations, the council will be tasked with accomplishing the following items by January 2021:

JCHS Report Sheds Light on Lack of Affordable Housing Production

Harvard University’s Joint Center for Housing Studies (JCHS) recently released its annual report, “The State of the Nation’s Housing 2019.” The report examines the state of the housing market in 2018, finding that, while the housing market improved in many respects over the previous year, including household growth and formations, the continued production shortfall has led to an increasing number of low- and moderate-income families who lack access to affordable housing options.

HUD Offers $150M to Provide Affordable Housing to People with Disabilities

Assisted Housing Insider - Wed, 07/17/2019

HUD is offering $150 million in grants to provide affordable housing to approximately 18,000 non-elderly persons living with disabilities. HUD anticipates awarding 300 grants ranging from $20,000 up to $3 million to eligible public housing agencies. HUD’s Mainstream Housing Choice Voucher Program provides funding to public housing agencies to assist non-elderly persons with disabilities. Agencies are encouraged to partner with health and human services organizations to provide participants with supportive services.

HUD Offers Largest Funding Amount to Clean Up Lead in Housing

HUD recently announced a record $330 million in grants to clean up lead-based paint hazards and other housing-related health and safety hazards in low-income housing. These grants are provided through HUD’s Lead Hazard Reduction and Healthy Homes Production for Tribal Housing grant programs and will direct critical funds to qualifying cities, counties, states, and Native American tribal governments to eliminate dangerous lead paint hazards. HUD is making grants available through the following programs:

The Housing Stability and Tenant Protection Act of 2019: What You Need to Know

On June 14, 2019, the New York State Legislature enacted the Housing Stability and Tenant Protection Act of 2019 (the Act), which significantly altered existing rent control and rent stabilization laws. The Legislature followed up on June 25, 2019, by enacting a “Clean Up Bill” to clarify some provisions of the Act. Most provisions of the Act became effective immediately on June 14, 2019.
